Woman Hits Teen and Sues His Family Over Trauma

In October of 2012, Brandon Majewski (17) was biking home after grabbing a quick bite with his two friends, Richard McLean (16) and Jake Roberts (16). Upon riding his trusty steel steed, Brandon encountered the wicked Sharlene Simon, a motorist who hit the teens from behind. Majewski died shortly after the crash, and it was ruled that the lack of visibility of the cyclists contributed to the accident.

Needless to say, the subsequent death of Majewski had caused enough tragedy for the family, however merely 18 months later, Simon decided to sue Majewski’s estate for grants greater than one million dollars. Simon’s attorney had filed a statement of claim in Ontario Superior Court last December, stating that Simon had “sustained and will sustain great pain and suffering” and “a severe shock to her system”, also saying that “her enjoyment of life has been and will be lessened.”

On a radio talk show on April 28th, 2014, Simon blames the boys, calling them “incompetent bicyclists”. Simon claims that her lawsuit is only in response to the Majewski’s, who is suing Simon and Simcoe County for a total of nine hundred thousand dollars. The Majewski’s lawsuit alleges Simon was under the influence, speeding, or texting during the time of the accident.

“So I guess the excuse would be: They started it,” talk show host Pat surmised. “Is that it? It’s probably her lawyer, I would imagine, saying, ‘All right, maybe you can scare them out of their suit against you by suing them for even more.’”

“I don’t see how that is going to happen. What judge, what jury would look at a case like this and say, ‘It’s okay for the person who killed a child to sue the parents of that child because the child was in the way of their car,’” Pat’s co-host Stu asked. “There’s a level of common courtesy, where you don’t sue the family of the child who you killed because you feel stressed out.”
